1. Acknowledgment of Risk & Assumption of Risk

Participant acknowledges that agritourism activities involve inherent risks, including those related to land, animals, equipment, and the participant’s own potentially negligent actions. Participant voluntarily assumes these inherent risks.

2. Hold Harmless / Release Clause

To the maximum extent permitted by law, Participant and their heirs, successors, and assigns hereby agree not to hold liable the Operator, its members, employees, agents, or assigns for any injury, death, damage, or loss arising from participation in any agritourism activities, whether on or off the premises, except in cases of gross negligence or willful misconduct.

3. Statutory Notice (Florida Statute § 570.89 Requirement)

WARNING Under Florida law, an agritourism operator is not liable for injury or death of, or damage or loss to, a participant in an agritourism activity conducted at this agritourism location if such injury, death, damage, or loss results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury, death, damage, or loss. You are assuming the risk of participating in this agritourism activity.

4. Photography & Likeness Release

Participant grants Operator, without expectation of compensation, the irrevocable right and permission to take, use, publish, and distribute photographs, video recordings, or other images and likenesses of Participant taken during any CowTyme LLC or Florida Aberdeen Mini Cows activity. This includes, but is not limited to, use for advertising, marketing, website content, printed materials, and social media posts. Participant understands that such media may be edited, altered, or modified, and waives any right to inspect or approve the finished product or the use to which it may be applied, releasing Operator from any related claims.

5. Compliance Requirement

Participant acknowledges that proper signage has been posted at the entrance and the activity site in compliance with Florida Statute § 570.89(1).

6. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7. Governing Law

This Agreement is governed by the laws of the State of Florida.
